A well-structured tender is an important foundation for the successful construction of your photovoltaic park. In a tender, several companies are invited to submit bids and the bids are compared against uniform criteria. This creates price transparency and makes scope and price comparable. For agri-PV, the agricultural use belongs in the performance specification, because it determines the mounting structure and row spacing. Warranty, deadlines and acceptance conditions must also be defined. A bill of quantities with clear items and quantities makes the bidders' prices directly comparable.
A clear performance specification based on the planning helps to avoid misunderstandings between the client and the contractors from the outset. How far the description extends also has legal consequences. For construction works in Austria, ÖNORM B 2110, the standard for works contracts, is frequently agreed as the contractual basis. If it is agreed, it allocates deviations from the services to spheres: the tender documents and the definition of the contractual scope lie in the client's sphere, while calculation and execution risk lie with the contractor. The agreed version and the specific contract documents are decisive. There are supplementary standards for standardised performance specifications and for the electronic exchange of tender and bid data.
A complete, consistent tender therefore has a direct effect on variation orders and construction time. For civil works for roads, trenches and foundations, it must also be defined whether measurement is based on the planned dimensions or on the dimensions actually executed. For their part, the companies are required, in line with the statutory and contractual duties to check and warn, to point out apparent concerns and significant circumstances, and an inspection of the local conditions may be provided for in the tender documents; even supervision by the local building supervision does not relieve them of their own duty to check and warn. If the procedural standard ÖNORM A 2050 is agreed, it describes the path from the tender through the bid to the award; public contracting authorities must also observe the statutory procurement rules. In practice, this includes a bidder list, dispatch of the documents, bidder questions with answers to all participants, bid opening, checks for completeness and plausibility, and an award recommendation.
Safety on site also belongs in the documents. Under the Construction Works Coordination Act (BauKG), the planning coordinator prepares the safety and health plan (SiGe plan). If it is included in the tender documents and expressly specified as part of the contract, the executing companies are contractually bound by it.
